Frandzen Communication

By accessing our services, creating an account, or organizing your collection on our registry, you agree to comply with and be bound by the following terms. If you do not agree, please do not use the application.

1.1 Eligibility & Account Registration

You must be at least 18 years of age (or the legal drinking age in your country of residence) to register an account with All Your Bottles. You are responsible for safeguarding your credentials and assume full responsibility for all activities occurring under your account.

1.2 Bottles Registry, Valuations & AI Sommelier Disclaimers

All Your Bottles provides a shared catalog of wines, spirits, producers, and merchants. Some features incorporate generative AI assistance and algorithmic modeling to compile production histories, culinary food pairings, drinking windows, and estimated market valuations. All registry and sommelier data are provided strictly for general informational, recreational, and educational purposes.

All Your Bottles is not a certified appraiser, enological consultant, licensed sommelier, or financial advisor. Estimated drinking windows, vintage ratings, and market valuations are speculative estimates and do not guarantee bottle condition, flavor maturity, or resale value. You acknowledge that deciding when to uncork, purchase, store, or sell any bottle is entirely at your own discretion and risk, and we assume zero liability for any ruined, oxidized, or depreciated bottles, or for any commercial or culinary decisions based on platform content.

1.3 Service Availability, Maintenance & Downtime Disclaimer

All Your Bottles is provided strictly on an "AS IS" and "AS AVAILABLE" basis. While we strive to maintain dependable service, we do not warrant that the application will be uninterrupted, continuous, timely, error-free, or entirely secure. The service does not come with a service-level agreement (SLA) or uptime warranty.

We reserve the right to perform scheduled or emergency maintenance, deploy system upgrades, modify platform features, or temporarily suspend access at any time without prior notice or liability. We shall not be liable for any downtime, connection failures, network latencies, cloud host or CDN disruptions (including third-party infrastructure failures), or cyber-attacks that may render the platform or any digital wine list/menu inaccessible.

1.4 Data Integrity, Independent Backup Duty & Complete Data Loss Disclaimer

All Your Bottles is a digital inventory organization tool; it is not a permanent data archival service or an insurance repository. You bear the sole, affirmative duty and legal responsibility to maintain your own independent, external backups and records of your cellar inventory, bottle receipts, purchase histories, valuation benchmarks, and personal tasting notes (such as through our export tools).

While we employ industry-standard database safeguards and recovery snapshots, software crashes, cloud provider failures, hardware malfunctions, database corruptions, rollback occurrences, or user mistakes may occur. To the maximum extent permitted by applicable law, Frandzen Communication expressly disclaims any and all liability for any loss of data, corrupted files, accidental record deletion, unrecoverable tasting notes, or inventory discrepancies. Under no circumstances do we guarantee that deleted or corrupted data can or will be restored.

1.5 Disclaimer of Warranties

To the fullest extent permissible under applicable law, All Your Bottles, Frandzen Communication, and our officers, directors, and suppliers disclaim all warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy of catalog data, and non-infringement. We do not warrant that the service will meet your specific personal or commercial requirements or that any errors will be corrected.

1.6 Limitation of Liability & Monetary Liability Cap

To the maximum extent permitted by applicable law, in no event shall Frandzen Communication, its owners, directors, employees, affiliates, or licensors be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages whatsoever—including but not limited to lost profits, lost revenue, lost sales (including restaurant or venue wine list downtime), loss of goodwill, loss of data, cost of substitute services, business interruption, or physical damage/spoilage to bottles or cellars—arising out of or related to your use of, or inability to use, the service, even if advised of the possibility of such damages.

Non-Paying / Free Tier Users: For users of our free tier, trial features, or any unpaid services, the platform is provided solely as a courtesy without monetary consideration. Frandzen Communication's total aggregate liability to any non-paying user shall be strictly 0.00 DKK / €0.00. Your sole and exclusive remedy in the event of any downtime, data loss, defect, or dispute is to discontinue use of the platform and delete your account.

Paying Subscribers: For paying customers, our total aggregate liability arising out of or related to these Terms or the service, whether in contract, tort (including negligence), or otherwise, shall be strictly capped at the total amount actually paid by you to All Your Bottles in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud, intentional misconduct, or gross negligence (forsæt eller grov uagtsomhed) where liability cannot be excluded under mandatory Danish law.

1.7 Physical Bottle Storage & Cellar Disclaimer

All Your Bottles is purely a digital software application. We do not inspect, handle, store, transport, or insure physical wine or spirit bottles. We have no control over your physical cellar conditions, storage temperatures, humidity levels, cork integrity, or security. You are solely responsible for physically caring for, safeguarding, and insuring your collection against fire, theft, temperature spoilage, and physical damage.

1.8 User Content & Permanent Product Database Rights

When you submit information to the global catalog—including but not limited to wine or spirit names, years, categories, regions, producer details, merchant names, and upload bottle or label images (collectively, "Product Data")—you grant All Your Bottles, its creators, and related entities a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Product Data in any media.

This grant applies strictly to objective product specifications and images that do not contain personally identifiable information. Your private tasting notes, purchase history, collection quantities, and credentials remain private and confidential under our Privacy Policy. You acknowledge and agree that because Product Data serves the collective integrity of the global wine registry, any objective Product Data or label images you contribute will be retained in our database permanently, even if you delete your account or request the erasure of your personal data.

1.9 Intellectual Property & Fair Use Policy

All Your Bottles respects the intellectual property rights of others. Product names, labels, trademarks, and logos displayed in the catalog are the property of their respective producers or brand owners. Catalog information and label images are displayed for informational, educational, and cataloging purposes under fair use/fair dealing principles. Users represent and warrant that they have the right to submit any Product Data or label images they upload. If you are a copyright owner and believe that any content on the site infringes your copyright, please contact us at contact@allyourbottles.com for immediate review and removal.

1.10 Third-Party Services & Payment Processing

Payment processing is provided directly by independent third-party payment gateways (including Stripe). All Your Bottles does not store raw payment card numbers. We are not responsible for payment gateway disruptions, banking surcharges, or foreign transaction conversion fees. Third-party content delivery networks (BunnyCDN), AI inference providers, and external data registries operate under their own independent terms and availability, and we disclaim any liability for interruptions or inaccuracies originating from such external services.

1.11 User Indemnification

You agree to defend, indemnify, and hold harmless Frandzen Communication, its owners, officers, and contractors from and against any third-party claims, liabilities, damages, losses, costs, or legal fees arising out of or related to your breach of these Terms, your misuse of the service, or any infringing or unlawful content you submit to the catalog.

1.12 Account Suspension & Termination

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice or liability, if you breach these Terms of Use or engage in conduct that harms the integrity of the platform.

1.13 Force Majeure

Neither Frandzen Communication nor the user shall be held liable for any failure or delay in performing obligations under these Terms if such failure or delay is caused by events beyond reasonable control, including acts of God, extreme weather, warfare, terrorism, cyber warfare, denial-of-service attacks, national or global telecommunication failures, power grid collapses, or statutory restrictions.

1.14 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Denmark, excluding its conflict of laws principles. Any disputes arising out of or in connection with your use of the service shall be subject to the exclusive jurisdiction of the City Court of Lyngby or the competent Danish courts, unless mandatory consumer protection regulations in your country of residence dictate otherwise.

1.15 Changes to These Terms

We reserve the right to update or modify these Terms of Use at any time. When updates are made, we will revise the "last updated" date at the top of this page. Your continued use of All Your Bottles following the posting of changes constitutes your acceptance of the revised Terms.

2. Privacy & Cookie Policy

We believe in absolute data transparency. While we may use anonymized, aggregated statistics (such as the number of users owning a specific bottle, quantities, and wine type distributions) and your public contributions (such as public reviews and ratings) to generate statistics, offer personalized recommendations, and improve the site, your private information remains completely confidential. We do not sell, trade, or rent your data to third parties.

2.1 Personal Information Collected

We collect minimal credentials upon registration: your username, email address, and password (stored securely as a cryptographic hash). You may also optionally specify your country of residence under Settings. We store the records of the bottles you add to your personal inventory, storage locations, pricing details, and private notes. Personal Tasting Notes remain completely private from the public and are never published to the global catalog; however, if you participate in a Shared Collection, your notes on those shared bottles will be visible to the other members of that specific collection. For Community Reviews, you have granular visibility controls: you can choose to share reviews publicly with your username or mark them as private. You can toggle review visibility or permanently delete your reviews at any time, and set your default review visibility in your Settings.

2.2 Cookies & Local Storage

We utilize only essential, functional cookies and browser storage to support login sessions, CSRF security verification, and remember your visual interface theme selection (e.g. light or dark theme mode). We do not deploy advertising, tracking, or marketing cookies. By using the service, you consent to the use of these essential functional cookies.

2.3 Third-Party Services & AI Submissions

We utilize generative AI models to analyze global catalog specs. When fetching Sommelier details, only generic bottle specifications (such as producer name, year, and name) are sent to the AI API endpoint. Absolutely no personal user data or private tasting notes are shared with any third-party AI providers.

2.4 Business Transfers & Ownership Changes

In the event that All Your Bottles undergoes a business transition, such as a merger, acquisition, or sale of all or a portion of its assets, user data (including collection statistics and account information) may be among the transferred assets. In such cases, your personal data will remain subject to the promises made in any pre-existing Privacy Policy unless you are notified otherwise.

2.5 Statutory Data Retention & Bookkeeping

Financial transaction and billing records (such as subscription invoices, VAT calculations, and transaction references) are retained for 5 years in compliance with statutory bookkeeping and tax legislation (Danish Bookkeeping Act / Bogføringsloven § 10), even after an account is deleted.

2.6 Anonymized Rating Aggregation

Personal bottle ratings (1-10 scale) may be aggregated and anonymized by the system to calculate global community averages and insights. By rating a bottle, you consent to this metric being used for platform-wide analytics.

2.7 Email Communications & Site Updates

We strictly separate essential account notifications from optional site updates. Essential transactional messages (such as security notices, password resets, account verification, and statutory invoices) are sent as a necessary part of providing the service. We only send occasional site updates, feature announcements, and platform news if you have explicitly chosen to receive them. You can opt in or out of site updates at any time in your Account Settings or by clicking the one-click unsubscribe link included in the footer of every update email.
